President Marcelo Rebelo de Sousa returned the draft Nationality Law to Parliament this Friday, December 19th. The procedure is mandatory when legislation is rejected by the Constitutional Court (TC).
“[s]and the Constitutional Court rules on the unconstitutionality of a rule contained in any decree or international agreement, the diploma must be vetoed by the President of the Republic or the Representative of the Republic, as the case may be, and returned to the body that approved it”, appears in the note published on the presidency’s website. This same excerpt was sent in a letter by Marcelo to the president of the Assembly of the Republic.
Now, the Government will adjust the points of the law rejected by the TC for a new vote. The processing will take place after the end of year holidays. The executive hopes that the path will be similar to that of the Foreigners Law, also failed by the judges at Palacio Ratton. The law was returned and, within a few weeks, it was approved and promulgated by Marcelo.
O What has not yet been defined in this case is whether the new law will count on votes from the Socialist Party (PS), who sent the inspection request to the TC, or Chega, which was decisive in the first version of the approved text.
